TOWN WINS LAWSUIT RE HAMPSHIRE MANAGEMENT-QUALITY OF LIFE

Good news for the town and residents of the Colony in Hartsdale! Judge Robert DiBella dismissed Hampshire Management's Article 78 petition and upheld the Town Board's April 6, 2006 Amended site plan approval requiring Hampshire Management to relocate a Knox lock, chains and an electrical transformer to a location approved on the approved 2003 amended site plan. It was never denied that the government can regulate land use.
The government can declare war, institute parking fines, speed limits and regulate a whole host of matters, local, domestic and abroad.

The issue I have presented is WHETHER the gvoernment should stick its nose into some matters and when it does whether it follows a legal course.

And as I understand this particular matter, this was an issue of whether the defendant COMPLIED with agreements that it accepted as part of the process to allow an expansion of the shopping center. (Trader Joe's and Best Buy).

Keep up your diligence, but be careful of tripping while trying.
