APPELLATE DIVISION REVERSES DECISION- VILLAGES MAY NOW INTERVENE

On 9/25 the Appellate Division, 2nd Judicial Dept reversed a lower court decision (Bernstein Vs. Feiner) and said that villages could intervene in the lawsuit. Mr. Bernstein had opposed the intervention. The decision the court makes will impact whether approximately $10 million in expenses re: parks/recreation is shifted to the villages.

The decision doesn't decide the case. It only lets the villages in. Bernstein's effort to control things has gone bust. His time is runing out. The court will tell us what the law is. No point spending time talking about it now.

All this means is that when the villages lose, no one will be able to complain that they didn't have their day in court.

The Appellate Division might be thinking about declaring Finneran unconstitutional (a point on which they did ask to be briefed). If they are about to toss out Finneran, it would make sense to give the Villages an opportunity to make the case for Finneran - hence this ruling. If, on the other hand they were just going to decide in favor of the Town, the Court wouldn't need to include an opportunity for the Villages to make their case as the outcome would be what the Villages want.
This might be a pyrhhic victory for the Town and Villages.

Good down with Bernstein.He thought that he is above all others.I do hope that the courts rule in favor of the town and villages.

This blog is a waste of time, other than for the limited purpose of informing the public that the villages will have their day in court in the second Bernstein lawsuit. The decision from the appeals court in the first lawsuit will come soon and tnen we will know what the law is, and it will affect the new case in which the vilages wil play a part. Let's just wait.

What will Bernstein say after the court reverses the Taxter Ridge case? Bernstein has an excuse and an explanation for everything, look how he explains the Bass-Barnes-Berger loss, it is because some anti-Feiner people stayed home.

Is he going to say that the judges on the appeals court couldn't read? Bernstein will finally have no explanation, because he was just plain wrong and deceptive about the law.

A Bernstein victory assures the political defeat of Sheehan in two years. Sheehan is so closely alligned with Bernstein that the villages will come out in droves to evict Herr Sheehan from Town Hall.

Sheehan's defeat in two years is assured in any event. He has made himself the most hated person in Greenburgh (next to Bernstein, of course) by his arrogance, secrecy, and nastiness.

sheehan voted to appeal the bernstein case. that was a pro-village vote.

a bernstein victory will probably impact feiner more as he was the one who spearheaded the purchase of taxter ridge. sheehan wasnt even on the tonw board.

sonya and kevin will have no clue how to handle a bernstein victory.

the only possible way to resolve the case may be thru albany and no one there is going to help feiner so fast.

Sheehan will NEVER BE ABLE to separate himself from Bernstein. They are connected at the hip. Sheehan's disposition has doomed his political future and his association with Bernstein is icing on the cake. Bob Bernstein is probably the most despised person in the entire Town.

6:55 I think you need help in having faith in a person who swore to defend the law who now finds himself on the other side of the law.
Bernstein did something wrong that needs to be addressed as soon as possible.
He tried to get this parcel for himself and McNally.WHY?
No one in Edgemont knew about this transaction until it hit the newspapers.
As far as his law suits,did he ask anyone or tell anyone of this decision,no.
No one in Greenburgh knew what he wanted to do until it was already in motion.
Is this a good way of practicing law?.

At no time, in no document, nor is it even alleged in the confabulated Troy affidavit, was the property ever to be conveyed to McNally.
