TOWN WINS LAWSUIT RE: kathwood

On October 2, 2008, Judge Mary H. Smith of the State Supreme Court granted the Town’s motion to dismiss claims brought by WBRC (Kathwood Road subdivision developers) alleging that the Planning Board unreasonably delayed their application to develop six lots on Kathwood Road in the Orchard Hill section and that the Planning Board selectively deemed the six lots to be in a Critical Environmental Area (CEA) warranting additional scrutiny. In rejecting WBRC’s claim for damages, the Court concluded that there was no evidence that the Planning Board acted irrationally or arbitrarily and that any delays in review were attributed to WBRC’s failure to timely amended their subdivision application.



The Court, in a previous decision, had required that the Zoning Board grant an area variance to WBRC to develop the sixth lot.

Isn't it odd that a decision from October 2 only now finds its way to the blog. Clearly there are as many news items stacked up waiting to land as there are jets over NYC airports.

Hal, if you were Feiner and had started the day by attacking the state for giving out STAR rebate checks to Greenburgh's elderly poor population, so they can pay for food and heat this winter (not to mention Greenburgh's high town taxes), you'd want to change the subject too.

Well Paul youthink tht you won the case well your're wrong.
You took another six homes off of the tax roles.
When will you see what you are doing in stopping develpment.
The judgement was made because of the frienship of a certain politico.
I guess if it were joe schmo initiating the law suit he would loose.
As the saying goes it's not what you know but woh you know.

INVOICE FOR GAY SILVERMAN

Whereas you have entered into an agreement to rent space at the Theodore D. Young Community Center, and as a good responsible taxpayer, conscientious of the financial burden placed on our valued town residents, this letter serves to remind you that you owe $20,000.00 in rental fees which was duly noted from last January. Simply put, we taxpayers don’t know where you get the chutzpa from, to go to a town board meeting and play victim while shamelessly pandering to temporary commissioner, Valerie Whitehead. Add to the fact that you put down the efforts of the entire staff, who work hard every day to put out the best programs possible plus contrary to your comment, do indeed welcome everyone who enters through the center’s doors.

Now let’s figure this out:

A Valerie desperately needs money.
+ B You haven’t paid your bill.
= C: More shady wrongdoings!

Can you smell kickback?

It’s highly suspect when the department head praises the efforts of a space renter who is ten months behind in her rental fees. The temp lady should have initiated some efforts to collect money that was due to the town!

Paul, please investigate this.

PS. Gay, I’m sending you some kneepads. They should be useful at your next town board meeting.

I think the personal accusations should stop as well but again WHEN WILL SILVER STREAKS PAY THEIR FEES????? Why is this still going on??????? And why the heck was Valerie Whitehead not placed on some type of administrative leave while all this police business is being looked into. And now that we have a new commissioner of the TDYCC...what is Valerie doing now?

Paul you know very well that these people owe the town money .
Could it be possible that the expenses incurred by certain facilities in Fairview have not to pay what they owe.
Why must we pay to keep these establisments alive.
Now is the time to collect all funds .
$500,000.oo from the housing authority.
All the money owed by the swim team.
And it's about time that you raise the fees for the use of the center and babysitting.
If you decide not to you had better close them down.
We refuse to pay out any more money to give out all the freebees that you think these poor people deserve.
There are no poor people in Fairview. They say they are poor to get what they can free.

Cora Carey should not be reappointed to the TDYCC Advisory Board unless and until the Housing Authority repays the town the money owed to town taxpayers. She is the Chair of the Housing Authority and has an obligation to make sure that the financial obligations are kept. Hope the Town Board will be firm and say no to her reappointment.

Cora Carey chairs the GHA which owes the town big money. How can the Town Board, in good conscience, reappoint Cora Carey to the TDYCC unless the GHA pays their big debt to the town?

commented on the over one half a million plus owed.
If she does not get her way she will probabley get Sharpton to fight her cause.

ACTING TDY COMMISSIONER WHITEHEAD LAUGHS AT AQUATICS DIRECTOR FIRING

I have been using the TDY pool for four years. But today was the last day I will ever enter through the doors of that Community Center. When I asked about what happened to Patricia Roper, in a vivid illustration of almost demonic proportions, Whitehead gleefully implied that she was no longer working at the Center. I was disgusted as to how giddy and cruel her mannerisms were at the point of my question. It was very clear that she took some type of perverted sick pleasure over someone’s loss of employment.

In the last two years Ms. Roper has been the Aquatics Director, I’ve seen a tremendous improvement in programs, staff courtesy, and equipment upgrades including a brand new electronic scoreboard, not to mention her determined advocacy of the FAST swim team. I don’t know what happened to cause Ms. Roper’s apparent termination but there was no reason for me as a Greenburgh resident to be subject to Whitehead’s attempt to denigrate and take joy from someone else’s pain. It seems hard to believe that with Whitehead’s attitude she’s employed at a community center. Her vindictive display is a poor example to our children.

Does Whitehead’s unprofessional behavior reflect the integrity, ethics, and motus operandi of you and our council members? Please answer this Paul.

More should be shown the door.
that's the problem with this town,NO MANAGERIAL SKILLS IN ANY DEPARTMENT.
Whatever the center wanted thru out the years they received NO questions asked but now the demands are being checked out because we the tax payers are up in arms.
We kept our mouth shut for too long and you can see where it got us and God knows where we will be going in the next few years.

Why keep a place opened that does not pay for itself.

Has this place ever brought in some money?
